Terms of Service

These Terms of Service ("Terms") govern your use of ofnexconsulting.ai (the "Site"), operated by Ofnex Consulting Inc. ("Ofnex," "we," "us"), a company incorporated in Ontario, Canada. By using the Site, you agree to these Terms.

1. The Site is informational

The Site describes Ofnex's services and past work, and provides ways to contact us. Nothing on the Site constitutes a binding offer, quote, or guarantee of results. The actual scope, price, and timeline for any engagement are set out in a separate, signed statement of work or engagement letter.

2. Client engagements are governed separately

If you engage Ofnex for services — an AI Readiness Audit, automation build, security review, training, retainer, or website project — that engagement is governed by its own signed agreement (including a mutual NDA where applicable), which takes precedence over this Site's content in the event of any conflict.

3. Acceptable use

You agree not to: misuse the Site or its contact/booking forms to send unlawful, abusive, or fraudulent content; attempt to gain unauthorized access to the Site or its underlying systems; or scrape, copy, resell, or misrepresent the Site's content as your own.

4. Intellectual property

The Site's design, code, text, graphics, and the Ofnex name and logo are the property of Ofnex Consulting Inc. and may not be copied or reused without written permission. Intellectual property in deliverables produced during a client engagement is governed by that engagement's statement of work — Ofnex's standard practice is that clients own the code and workflows built for them.

5. Third-party services

The Site uses Formspree (contact form), Calendly (scheduling), and — only with your consent — Google Analytics (usage analytics). Your use of those tools through the Site is also subject to each provider's own terms.

6. No warranty

The Site and its content are provided "as is," without warranties of any kind, to the fullest extent permitted by law. We take reasonable care to keep information accurate and current but do not guarantee it is error-free or uninterrupted.

7. Limitation of liability

To the fullest extent permitted by law, Ofnex Consulting Inc. is not liable for any indirect, incidental, or consequential damages arising from your use of the Site. This limitation does not apply to obligations Ofnex takes on under a signed client engagement agreement, which governs separately.

8. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
